OVERVIEW

This website is operated by Benzoinum. Throughout these Terms of Service, the terms “Benzoinum,” “we,” “us,” and “our” refer to Benzoinum and, where applicable, the entity responsible for operating Benzoinum.com.

Benzoinum provides this website, together with the information, products, services, tools, features, and functionality made available through it, subject to these Terms of Service (“Terms”) and the policies incorporated into these Terms by reference.

By accessing Benzoinum.com, using any part of the website, creating an account, or placing an order, you agree to be bound by these Terms.

These Terms apply to all users of the website, including visitors, customers, and other persons who access or use the Service.

Please read these Terms carefully before using Benzoinum.com. If you do not agree to these Terms, you should not use the website or place an order.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which Benzoinum offers products and related services.


SECTION 1 - ELIGIBILITY AND ONLINE STORE TERMS

By using the Service, you represent that you have reached the age of majority required to enter into a legally binding contract in your jurisdiction, or that you are otherwise legally authorized to enter into the transaction.

You must not use Benzoinum.com, our products, or the Service:

  • In violation of applicable laws or regulations;
  • To infringe the intellectual property or other legal rights of any person;
  • To transmit malicious software, viruses, harmful code, or other disruptive material;
  • To interfere with the security or operation of the website; or
  • To attempt unauthorized access to systems, accounts, networks, or data.

A material breach of these Terms may result in suspension or termination of access to the Service.


SECTION 2 - GENERAL CONDITIONS

Benzoinum may refuse, restrict, suspend, or cancel access to the Service where reasonably necessary and permitted by applicable law, including where:

  • Fraudulent or unauthorized activity is reasonably suspected;
  • Payment cannot be authorized;
  • An order cannot lawfully be fulfilled;
  • A customer materially breaches these Terms;
  • Security of the website or payment systems is threatened; or
  • Applicable law, regulation, court order, or regulatory requirement requires such action.

Information transmitted through the Service may pass through different networks and may be adapted to technical requirements.

Sensitive payment information is processed through secure payment providers and encrypted transmission methods.

Except where expressly permitted by applicable law or authorized by Benzoinum in writing, you may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any substantial part of the Service.

Nothing in this Section limits any obligation imposed by applicable law concerning the accuracy of:

  • Delivery information;
  • Return and refund information;
  • Consumer rights; or
  • Contract terms.

Historical or general informational content is provided for reference and should not be treated as professional legal, medical, financial, or other specialist advice.


SECTION 4 - PRICES, PROMOTIONS AND CHANGES TO THE SERVICE

Product prices may be changed before an order is accepted.

A price change will not ordinarily affect an order already accepted and paid for, except where:

  • An obvious pricing or technical error has occurred;
  • The transaction cannot lawfully be completed at the displayed price; or
  • Applicable law permits correction.

Promotions, discounts, subscription offers, bundles, and other commercial offers are subject to the conditions disclosed at the time of purchase.

Benzoinum may modify, suspend, replace, or discontinue products, website features, or parts of the Service where reasonably necessary.

Nothing in this Section permits Benzoinum to retrospectively remove a statutory right that has already arisen.


SECTION 5 - PRODUCTS AND PRODUCT INFORMATION

Products are offered subject to availability.

We make reasonable efforts to display product images, shades, dimensions, packaging, specifications, and descriptions accurately.

Actual product appearance may vary reasonably because of:

  • Display and monitor settings;
  • Lighting conditions;
  • Photography;
  • Product shade;
  • Packaging updates; or
  • Normal manufacturing variation.

Such reasonable variation does not affect any statutory right relating to products that are defective, materially different from their description, unsafe, or otherwise legally non-conforming.

Certain products may be discontinued or restricted in specific locations for inventory, regulatory, shipping, or operational reasons.

Returns, refunds, exchanges, and remedies are governed by our applicable Return & Refund Policy together with any mandatory consumer protection law.


SECTION 6 - ORDERS, BILLING AND ACCOUNT INFORMATION

Customers are responsible for providing complete and accurate information when placing an order, including:

  • Full name;
  • Email address;
  • Billing address;
  • Shipping address;
  • Telephone number where required;
  • Payment information; and
  • Other information reasonably required to process the transaction.

Benzoinum may refuse, limit, or cancel an order where reasonably necessary, including where:

  • Fraud or unauthorized payment is suspected;
  • Payment authorization fails;
  • Product inventory is unavailable;
  • Material order information is incorrect;
  • Legal or regulatory restrictions prevent fulfillment; or
  • The order reasonably appears to involve unauthorized commercial resale.

Where reasonably possible, we will notify the customer if an accepted order is materially changed or cancelled.


SECTION 7 - PAYMENT

Payment methods available to customers are described in our Payment Options Policy.

Transactions may be subject to authorization, fraud screening, identity verification, cardholder verification, or other security measures imposed by the relevant payment provider or financial institution.

Submission of an order does not constitute payment approval.

Benzoinum does not directly store complete card numbers or CVV security codes where payment information is processed by authorized third-party payment providers.


SECTION 8 - SHIPPING AND DELIVERY

Shipping, processing times, delivery estimates, tracking, customs, and related delivery matters are governed by our Shipping Policy.

Delivery dates displayed on Benzoinum.com are estimates unless expressly stated otherwise.

Nothing in this Section limits statutory rights relating to delayed delivery, non-delivery, or other mandatory delivery obligations.


SECTION 9 - THIRD-PARTY TOOLS AND SERVICES

Benzoinum may provide access to services, payment methods, tools, applications, or functionality operated by independent third parties.

Such services may be subject to separate:

  • Terms and conditions;
  • Privacy policies;
  • Eligibility requirements;
  • Payment rules; and
  • Technical requirements.

To the extent permitted by applicable law, Benzoinum is not responsible for independent acts, omissions, outages, or failures of third-party providers outside our reasonable control.

Nothing in this Section affects any responsibility Benzoinum is legally required to assume for products or services sold directly by Benzoinum.


SECTION 10 - THIRD-PARTY LINKS

Benzoinum.com may contain links to third-party websites or services.

The existence of a link does not, by itself, constitute endorsement or control of the third-party website.

Customers should review applicable third-party terms and privacy policies before entering into a separate transaction with a third party.


SECTION 11 - USER CONTENT, REVIEWS AND SUBMISSIONS

Where you submit reviews, comments, photographs, suggestions, feedback, or other content to Benzoinum, you represent that you have the legal right to provide that material.

Unless otherwise agreed in writing, you grant Benzoinum a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, translate, display, distribute, and adapt submitted material for legitimate business purposes, subject to applicable privacy and intellectual property law.

Benzoinum may remove content that:

  • Is unlawful;
  • Is fraudulent or materially misleading;
  • Infringes intellectual property rights;
  • Violates privacy rights;
  • Contains malware or malicious code;
  • Contains unlawful threats or harassment; or
  • Materially violates these Terms.

SECTION 12 - PERSONAL INFORMATION

Collection and processing of personal information through Benzoinum.com are governed by our Privacy Policy.

The Privacy Policy describes the categories of personal information collected, purposes of processing, sharing practices, retention practices, and applicable privacy rights.


SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Benzoinum may correct genuine errors concerning:

  • Product descriptions;
  • Pricing;
  • Promotions;
  • Availability;
  • Shipping charges;
  • Delivery information; or
  • Other website content.

Where an error materially affects an order already submitted, the matter will be handled in accordance with applicable law and any mandatory consumer rights.

Nothing in this Section permits Benzoinum to avoid contractual or statutory obligations through unilateral correction of information after a consumer right has arisen.


SECTION 14 - PROHIBITED USES

You must not use the Service:

  1. For unlawful purposes;
  2. To solicit or encourage unlawful conduct;
  3. To infringe intellectual property rights;
  4. To submit fraudulent or materially misleading information;
  5. To transmit malware, viruses, or harmful code;
  6. To unlawfully collect personal information;
  7. To interfere with website security;
  8. To obtain unauthorized access to systems or accounts;
  9. To engage in unauthorized scraping or automated interference;
  10. To impersonate another person;
  11. To engage in unlawful harassment or discrimination; or
  12. To circumvent technical or security measures.

Benzoinum may restrict access where a material violation occurs.


SECTION 15 - WARRANTIES AND LIMITATION OF LIABILITY

Benzoinum takes reasonable measures to operate and maintain the Service.

However, to the maximum extent permitted by applicable law, Benzoinum does not guarantee that:

  • The website will operate continuously without interruption;
  • Every technical error will be corrected immediately;
  • Every third-party service will remain continuously available; or
  • Matters outside our reasonable control will not affect the Service.

To the maximum extent permitted by applicable law, Benzoinum and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses where such liability may lawfully be excluded.

Where applicable law prohibits or restricts an exclusion or limitation of liability, the relevant exclusion or limitation applies only to the maximum extent permitted by law.

Nothing in these Terms excludes, restricts, or limits any statutory consumer right, statutory guarantee, legal remedy, or liability that cannot lawfully be excluded, restricted, or limited.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Death or personal injury caused by negligence where such liability cannot lawfully be excluded;
  • Deliberate misconduct where applicable law prohibits exclusion;
  • Mandatory product-safety obligations;
  • Mandatory consumer guarantees; or
  • Any other liability that applicable law does not permit a business to exclude.

Your previous Terms contained broad warranty and liability exclusions, so this wording expressly subjects them to mandatory consumer protection law.


SECTION 16 - INDEMNIFICATION

To the extent permitted by applicable law, you are responsible for third-party claims arising directly from:

  • Your unlawful use of the Service;
  • Your material breach of these Terms;
  • Your infringement of third-party rights; or
  • Content unlawfully submitted by you.

No indemnification obligation applies to a consumer where such an obligation would be prohibited, unfair, or unenforceable under applicable law.


SECTION 17 - SEVERABILITY

If a provision of these Terms is determined by a competent authority to be unlawful, invalid, or unenforceable, the provision will be interpreted or limited to the minimum extent necessary to preserve its lawful effect.

If that is not possible, the unenforceable portion will be severed.

The remaining provisions will remain in force.


SECTION 18 - TERMINATION

Customers may stop using the Service at any time.

Benzoinum may suspend or terminate access where reasonably necessary, including where:

  • A material breach of these Terms occurs;
  • Fraudulent activity is reasonably suspected;
  • Security is materially threatened; or
  • Applicable law requires suspension or termination.

Termination does not affect rights, obligations, liabilities, payment obligations, or remedies that arose before termination.


SECTION 19 - ENTIRE AGREEMENT AND MANDATORY LAW

These Terms, together with the policies incorporated by reference, govern use of Benzoinum.com and transactions conducted through the Service.

Failure by Benzoinum to immediately enforce a provision does not constitute a permanent waiver of that provision.

Where these Terms conflict with mandatory consumer protection law applicable to a transaction, the mandatory consumer protection law prevails to the extent of the conflict.

No provision of these Terms shall be interpreted as requiring a consumer to waive a right that cannot lawfully be waived.


SECTION 20 - CONSUMER RIGHTS

20.1 General Application

Consumers may benefit from mandatory rights under the laws applicable to their place of residence or the transaction.

The regional provisions below summarize material consumer rights relevant to online purchases in the principal markets served by Benzoinum.

They do not replace applicable legislation.

Where applicable law provides a mandatory right or remedy that is more protective than these Terms, the mandatory provision will prevail.


20.2 EUROPEAN UNION

The principal online-shopping rules described in this Section apply throughout the European Union under harmonised EU consumer legislation.

For purposes of these Terms, this section applies to consumers in:

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.

Because the principal distance-contract rules are harmonised at EU level, substantially identical provisions are not repeated separately for each Member State.

Individual Member States may provide additional rights beyond the harmonised minimum.

20.2.1 Right of Withdrawal

A consumer who concludes an eligible online or other distance contract generally has the right to withdraw from the contract within 14 days without providing a reason.

For goods, the withdrawal period generally runs from receipt of the goods by the consumer or a person designated by the consumer, other than the carrier.

To exercise the right of withdrawal, the consumer must communicate an unequivocal decision to withdraw before expiration of the applicable period.

The notice should include sufficient information to identify the relevant order.

20.2.2 Return of Goods

Where a valid right of withdrawal is exercised, the consumer must return the goods within the period required by applicable EU law.

Unless Benzoinum agrees to bear the direct return cost, or Benzoinum failed to provide legally required information concerning return costs, the consumer may be responsible for the direct cost of returning the goods.

20.2.3 Reimbursement

Where withdrawal is valid, Benzoinum will provide reimbursement within the applicable statutory period.

Where required by EU law, reimbursement includes the cost of the least expensive standard delivery method offered for the order.

Additional costs resulting from a consumer's selection of a more expensive delivery method are not required to be reimbursed except where applicable law provides otherwise.

Where legally permitted, reimbursement may be withheld until the returned goods are received or the consumer provides evidence that the goods have been returned.

20.2.4 Exceptions

The right of withdrawal does not apply to every product or transaction.

Applicable statutory exceptions may include:

  • Goods made to the consumer's specifications;
  • Clearly personalized goods;
  • Goods liable to deteriorate or expire rapidly;
  • Certain digital content;
  • Certain services;
  • Sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed; and
  • Other categories excluded by applicable legislation.

For cosmetic and beauty products, a hygiene-related exception will be applied only where the statutory requirements for that exception are satisfied.

20.2.5 Legal Guarantee

EU consumers are entitled to a minimum two-year legal guarantee for consumer goods.

Where goods are faulty or do not conform to the contract, statutory remedies may include repair, replacement, price reduction, or refund in accordance with applicable law.

National laws may provide additional or longer protection.


20.3 UNITED KINGDOM

Online and distance contracts with UK consumers are subject to applicable UK consumer protection law, including distance-selling and consumer-rights legislation.

20.3.1 Cancellation of Distance Contracts

For eligible goods ordered online, consumers generally have 14 days after receiving the goods to notify the seller that they wish to cancel.

After providing valid cancellation notice, the consumer generally has a further statutory period in which to return the goods.

Businesses must also provide prescribed information concerning goods, prices, payment, delivery, and cancellation rights.

20.3.2 Refunds

Where cancellation is valid, Benzoinum will reimburse eligible payments within the period required by UK law.

Standard outbound delivery costs will be reimbursed where required.

The consumer may be responsible for direct return costs where such responsibility is permitted by law and was properly disclosed.

20.3.3 Exceptions

The statutory cancellation right is subject to legal exceptions, including certain categories of sealed goods that are unsuitable for return for health-protection or hygiene reasons once unsealed.

20.3.4 Faulty or Non-Conforming Goods

The cancellation right for distance purchases is separate from statutory rights relating to defective, unsatisfactory, unsafe, incorrectly described, or otherwise non-conforming goods.

Nothing in these Terms limits mandatory remedies available under UK consumer law.


20.4 UNITED STATES

The United States does not establish a general federal 14-day change-of-mind cancellation period for ordinary online retail purchases.

Change-of-mind returns are therefore governed primarily by Benzoinum's disclosed Return & Refund Policy and any applicable state law.

20.4.1 Federal Shipping Requirements

The Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, 16 CFR Part 435, applies to most merchandise ordered online.

Where a seller states a shipping period, the seller must have a reasonable basis for expecting shipment within that period.

Where no shipping period is stated, the Rule generally requires a reasonable basis for expecting shipment within 30 days.

If merchandise cannot be shipped within the applicable period, the seller must comply with the Rule's requirements concerning delay consent or refunds.

20.4.2 State Consumer Protection Law

Consumers may have additional rights under applicable state unfair-trade-practice, warranty, product-safety, contract, or consumer-protection laws.

Nothing in these Terms excludes a federal or state right that cannot lawfully be waived.


20.5 CANADA

Canada does not have a single nationwide consumer cancellation regime equivalent to the EU's general 14-day distance-contract withdrawal right.

Consumer contract regulation is substantially governed by provincial and territorial legislation.

Accordingly, the provisions below distinguish several principal provincial online-purchase regimes.


20.5.1 Ontario

Where the applicable requirements are satisfied, qualifying online transactions are treated as Internet agreements under Ontario consumer protection legislation.

Ontario's official consumer guidance confirms that qualifying online transactions are subject to rules concerning pre-contract disclosure and Internet agreements.

A business may be required to provide prescribed information before the consumer enters the agreement and comply with applicable contract-copy requirements.

Statutory cancellation rights may arise where legally required information or procedural requirements are not satisfied.

Such rights do not constitute an unrestricted general change-of-mind return right.


20.5.2 British Columbia

Online, telephone, email, and similar remote transactions may constitute distance sales contracts under British Columbia consumer legislation.

For contracts entered into on or after August 1, 2026, updated requirements apply to pre-purchase disclosure and distance sales contracts.

Businesses must provide prescribed information and permit consumers to review and correct relevant information before completing the purchase.

Depending on the circumstances, statutory cancellation rights may arise where:

  • Required pre-purchase disclosures were not provided;
  • Mandatory contract information was omitted;
  • Disclosure and contract terms are inconsistent;
  • A required contract copy was not provided; or
  • Goods were not delivered within the statutory delivery period.

British Columbia's official guidance also provides cancellation remedies where goods are not supplied within the legally prescribed period.

These rights are statutory remedies for specified circumstances and are not an unconditional general change-of-mind return right.


20.5.3 Québec

Online purchases may constitute distance contracts under Québec consumer protection law.

Merchants are required to provide prescribed pre-contract information and, subject to statutory exceptions, provide the consumer with a contract copy that can be saved and printed.

Québec's Office de la protection du consommateur states that the required contract copy must generally be provided within 15 days of purchase.

Failure to satisfy applicable requirements may give the consumer a statutory right to cancel the transaction.

Any mandatory rights available under Québec law prevail over inconsistent provisions of these Terms.


20.5.4 Other Canadian Provinces and Territories

Consumers located elsewhere in Canada remain entitled to mandatory protections available under the applicable law of their province or territory.

Where applicable provincial or territorial legislation provides a cancellation right, refund right, statutory warranty, disclosure requirement, or other mandatory remedy, that provision will apply notwithstanding any inconsistent term in these Terms.


20.6 AUSTRALIA

Purchases made by consumers in Australia may be protected by the Australian Consumer Law (ACL).

The ACL provides statutory consumer guarantees that apply automatically and cannot be removed by a business's contractual terms or a “no refunds” statement.

Goods must, where applicable:

  • Be of acceptable quality;
  • Be reasonably fit for their disclosed purpose;
  • Match their description;
  • Match applicable samples or demonstrations; and
  • Satisfy other statutory consumer guarantees.

Where goods fail to satisfy an applicable guarantee, consumers may be entitled to a statutory remedy, including repair, replacement, refund, or another remedy depending on the nature of the failure.

These rights apply to online purchases as well as other consumer transactions.

Australian Consumer Law does not generally require a retailer to provide a refund solely because a consumer has changed their mind, unless the retailer separately provides such a right.

Any voluntary Benzoinum return policy operates in addition to, and does not replace, ACL consumer guarantees.


20.7 NEW ZEALAND

Where applicable, online purchases involving New Zealand consumers are subject to protections under the Consumer Guarantees Act and Fair Trading Act.

Official New Zealand consumer guidance confirms that the same consumer laws generally apply to online purchases as to purchases made through traditional retail channels.

Goods must, where applicable:

  • Be of acceptable quality;
  • Match their description;
  • Be fit for purpose; and
  • Be delivered within a reasonable time.

Where these guarantees are not satisfied, statutory remedies may include repair, replacement, or refund.

The Fair Trading Act also protects consumers from misleading and deceptive conduct.

New Zealand law does not generally provide an automatic statutory right to return goods solely because the consumer has changed their mind.

Mandatory rights available to New Zealand consumers remain unaffected by these Terms.


20.8 SINGAPORE

Consumer transactions involving Singapore consumers may be subject to the Consumer Protection (Fair Trading) Act 2003 (“CPFTA”).

The CPFTA prohibits unfair practices, including specified misleading, deceptive, or false representations, and provides consumers with statutory rights in relation to certain unfair practices.

The legislation also provides additional consumer rights in respect of certain non-conforming goods.

Nothing in these Terms limits a statutory remedy available under the CPFTA or other applicable Singapore law.

The CPFTA contains cancellation rights for specified categories of contracts, but Singapore law does not establish a universal EU-style change-of-mind cooling-off right for every ordinary online retail purchase.

Accordingly, ordinary voluntary change-of-mind returns remain subject to Benzoinum's Return & Refund Policy unless a mandatory statutory right applies.


20.9 FAULTY, DAMAGED, INCORRECT OR NON-CONFORMING GOODS

Any voluntary return period offered by Benzoinum is separate from mandatory statutory rights.

Where goods are:

  • Defective;
  • Damaged;
  • Unsafe;
  • Incorrect;
  • Not as described;
  • Materially different from the contract; or
  • Otherwise legally non-conforming,

the consumer may have mandatory remedies that continue regardless of whether Benzoinum's ordinary voluntary return period has expired.

Nothing in our policies prevents a consumer from exercising a statutory right that cannot lawfully be excluded.


20.10 COSMETICS, HYGIENE AND SEALED PRODUCTS

Certain jurisdictions permit statutory withdrawal rights to be restricted for sealed goods that are not suitable for return for health-protection or hygiene reasons after the seal has been broken.

Because Benzoinum sells cosmetic and beauty products, this statutory exception may apply to qualifying goods only where all legal requirements for the exception are satisfied.

A hygiene exception does not remove rights relating to goods that are:

  • Defective;
  • Unsafe;
  • Damaged before delivery;
  • Incorrect;
  • Misdescribed; or
  • Otherwise legally non-conforming.

20.11 SUBSTANTIALLY SIMILAR REGIONAL RULES

For the avoidance of doubt:

The 27 EU Member States are addressed collectively because the principal distance-selling withdrawal and legal-guarantee requirements described above are harmonised under EU law. Individual national laws may nevertheless provide additional rights.

The United Kingdom is addressed separately because UK consumer law now operates independently of EU law, notwithstanding substantial similarities in distance-contract cancellation rules.

Australia and New Zealand both provide strong mandatory product-quality and conformity protections, but neither should be described as having a general EU-style 14-day online change-of-mind withdrawal regime.

The United States, Canada, Australia, New Zealand, and Singapore should therefore not be treated as subject to an automatic EU-style 14-day withdrawal period unless a specific applicable law provides such a right.


20.12 OTHER COUNTRIES AND JURISDICTIONS

Consumers located in countries or regions not expressly listed above remain entitled to any mandatory rights provided under the consumer protection laws applicable to their transaction.

Nothing in these Terms is intended to:

  • Waive a mandatory statutory guarantee;
  • Exclude a mandatory refund or cancellation right;
  • Limit liability where limitation is prohibited;
  • Exclude rights relating to unsafe or defective goods; or
  • Prevent a consumer from exercising a remedy that cannot lawfully be waived.

Where applicable mandatory law provides greater protection than these Terms, the mandatory law prevails.


SECTION 21 - RETURNS AND REFUNDS

Benzoinum's voluntary return and refund arrangements are set out in the Return & Refund Policy.

The Return & Refund Policy operates in addition to mandatory statutory consumer rights.

Where a statutory right provides a different or more extensive remedy than our voluntary policy, the mandatory statutory provision will apply.


SECTION 22 - CHANGES TO THESE TERMS

Benzoinum may update these Terms where reasonably necessary to reflect changes in:

  • Applicable laws or regulations;
  • Consumer protection requirements;
  • Website functionality;
  • Products and services;
  • Payment services;
